Terms of Service

These terms are an agreement between you and SmartWaves LLC ("Dereal", "we", "us"). By creating an account or using Dereal, you agree to them. If you don't agree, don't use the service.

Dereal is an AI wellbeing coach. It is not therapy, counseling, or medical care. Dereal's coaches are AI software, not people and not licensed professionals. They don't diagnose, treat, or monitor any health condition, and talking with them is not a substitute for a doctor, therapist, or other qualified professional.

If you are in crisis or thinking about harming yourself or someone else, call or text 988 (Suicide & Crisis Lifeline) or call 911. Dereal is not an emergency service and does not contact anyone on your behalf.

1. Who can use Dereal

You must be at least 18 years old and live in the United States. By using Dereal you confirm both.

2. What Dereal is

Dereal offers conversations with AI coaches about everyday life: how you think, feel, relate, and grow. Coaches may suggest reflections or simple practices. They are general wellness tools for personal growth. Any suggestion is yours to take or leave, and you are responsible for your own decisions.

AI can be wrong. Replies may be inaccurate, incomplete, or not right for your situation. Don't rely on Dereal for medical, mental-health, legal, financial, or other professional advice.

3. Your account

You sign in with a Google account. Keep it secure; you're responsible for activity on your Dereal account. Tell us if you think someone else has accessed it.

4. Acceptable use

Don't use Dereal to:

break the law or encourage others to;
harass, threaten, or harm anyone;
try to get the coaches to produce sexual content, or content that exploits minors in any way;
access other people's data, probe or overload our systems, or reverse-engineer the service;
use automated tools to scrape or mass-use the service;
pretend Dereal's replies come from a licensed professional.

We may suspend or close accounts that break these rules.

5. Your content

What you say to Dereal stays yours. You give us permission to process it only to run the service for you: to reply, remember context you've shared, and show you your own history and progress. We don't sell it, and we don't use it for advertising. See the Privacy Policy for details.

6. Our content

The Dereal app, its coaches, voices, design, and text belong to us or our licensors. You may use them only to use the service for yourself.

7. Changes and availability

We may change, pause, or stop parts of Dereal at any time. We may update these terms; if a change is significant we'll tell you in the app before it takes effect. Continuing to use Dereal after that means you accept the new terms.

8. Ending your use

You can stop using Dereal and delete your account at any time from Settings. We may end your access if you break these terms or if we stop offering the service.

9. Disclaimers

Dereal is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent the law allows.

10. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from decisions you make based on conversations with Dereal. Our total liability for any claim relating to Dereal is limited to the greater of the amount you paid us in the 12 months before the claim or $50.

11. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Disputes will be handled in the state or federal courts located in Dallas County, Texas, unless the law requires otherwise.
